We do not support the Government's decision and we believe that amending the Criminal Code and the Criminal Procedure Code via emergency government ordinances was a mistake. The RMDSZ upholds its original view that both codes should be amended in accordance with the decisions of theConstitutional Courtand only subsequent to a parliamentary debate.
The hasteful, conspicuous manner in which the government acted is worrisome. We were similarly concerned by the amendment of the Criminal Code via an emergency government ordinance issued without any public debate in May 2016. That particular amendment practically positioned the prosecutor's office above the courts, yet it did not result in any public outcry at that time.
The indignation of the Romanian citizens is absolutely justified. The Parliament cannot be bypassed by the Government by adopting such emergency ordinances. Every attempt made so far to regulate this problem through an emergency ordinance involved serious errors.
The amendment of the Criminal Code however is necessary, as it currently has at least 40 provisions that were declared unconstitutional. It takes strong political will to correct it, as those who have tried so far to adopt such amendments were strongly criticized.
We therefore urge a proper, democratic debate in the Romanian Parliament, in order to harmonize the provisions of the two Codes with the decisions of the Constitutional Court.
